The Shift – Participant Waiver and Release of Liability

By registering for and participating in The Shift (the “Retreat”), you acknowledge and agree to the following terms and conditions. This Waiver and Release of Liability (“Agreement”) is entered into between you (“Participant”) and Healthcare Traveler Certification Academy (HCTA), the Organizer of The Shift.

Travel Requirements & Documentation

  • It is the sole responsibility of the Participant to obtain and carry a valid passport, any required visas, and all other necessary travel documentation to enter and stay in Vietnam.
  • The Organizer is not responsible for issues related to denied entry, missed flights, or delays caused by visa issues, incomplete travel documentation, or international travel disruptions.

Travel & Health Insurance

  • Participants are strongly encouraged to purchase comprehensive travel insurance that includes coverage for:
    • Trip cancellation or interruption
    • Medical treatment and evacuation
    • Lost, stolen, or delayed baggage

The Organizer does not provide travel or medical insurance and is not liable for any expenses incurred due to illness, injury, or property loss. 

Health, Safety, & Medical Emergencies

  • Participation is voluntary, and all participants should ensure they are in good physical and mental health before attending.
  • The Organizer assumes no responsibility for any illness, injury, or medical condition that may occur during or after the Retreat.

In case of a medical emergency, the Organizer may assist in accessing medical services but is not financially responsible for any treatment or transportation.

Program Flexibility & Schedule Changes

  • The event schedule is subject to change due to weather, local conditions, participant needs, or other unforeseen circumstances.

The Organizer reserves the right to modify the itinerary, activities, venues, or facilitators without prior notice, as needed to ensure participant safety and program quality.

Assumption of Risk

  • By attending, you acknowledge that international travel and retreat participation involve inherent risks, including but not limited to: transportation delays, unfamiliar environments, changes in local infrastructure, food sensitivities, and access to healthcare.

You voluntarily accept all such risks, whether anticipated or not.

Personal Property

  • Participants are responsible for their belongings at all times.

The Organizer is not liable for lost, stolen, or damaged personal items.

Conduct & Behavior

  • Participants are expected to act respectfully and responsibly throughout the retreat, in alignment with local laws and cultural norms.

The Organizer reserves the right to remove any participant without refund for conduct that is unsafe, disruptive, or disrespectful to others, the venue, or the local community.

Photography & Media Consent

  • By participating in The Shift, you grant the Organizer permission to use photos, video, and audio recordings taken during the event for promotional, educational, or marketing purposes.

If you do not wish to appear in media, you must notify the Organizer in writing prior to the event start date.

Liability Waiver

In consideration for participating in The Shift, you agree to release, waive, and discharge the Organizer (HCTA), including its owners, officers, directors, employees, contractors, partners, and agents, from any and all claims, liabilities, demands, actions, or causes of action for personal injury, property damage, illness, delay, inconvenience, or financial loss arising from or connected to your participation in the event, regardless of whether caused by negligence.

Governing Law & Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any legal dispute arising under or in connection with this Agreement or the Participant’s involvement in The Shift shall be subject to the exclusive jurisdiction of the courts located in the State of Delaware.

By completing your registration and submitting payment, you confirm that you have read, understood, and voluntarily accept the terms of this Waiver and Release of Liability.
